This Privacy Policy explains how Hug Millionaire LLC (“Company,” “we,” “us,” or “our”) collects, uses, discloses, stores, and protects information when you visit or use MarkTheirMoment.com under the Mark Their Moment brand, including related pages, checkout flows, public Moment pages, Moment Walls, emails, share tools, downloadable images, text/share tools, customer-support channels, and services (collectively, the “Service”).

MarkTheirMoment.com is a public digital recognition, celebration, and dedication platform. Users can purchase and submit personalized public pages (each, a “Moment”) for review and, if approved, public display. A Moment may include a recipient or subject name, dedicator name, dedication message, uploaded image, social profile link or handle, public Moment page, shareable link, downloadable image, suggested caption, Moment ID, Moment count, view count, Moment tier, visual marker, and related public-display features.

Because the Service is designed around public and shareable Moments, some information submitted through the Service may be intentionally published, displayed, shared, copied, downloaded, indexed, or made available to other people. Do not submit information that you or the recipient would not want displayed publicly.

By accessing or using the Service, submitting information, creating or purchasing a Moment, uploading an image, linking a social profile, signing up for emails, contacting us, or otherwise interacting with MarkTheirMoment.com, you acknowledge the data practices described in this Privacy Policy. This Privacy Policy should be read together with our Terms of Service.

2. What Do We Do With Your Information?

When you purchase or submit a Moment, upload an image, use a sharing tool, create, register, or use an account, contact us, or otherwise interact with the Service, we collect the personal information you provide to operate the Service and complete the interaction you requested. This may include your name, email address, billing information, order details, recipient name, dedicator name, dedication message, uploaded image, social profile link, and other details needed to create, review, approve, publish, support, or manage your Moment.

When you browse MarkTheirMoment.com, we and our service providers may automatically receive technical information from your browser, device, and network, such as your Internet Protocol (IP) address, browser type, operating system, device information, pages viewed, links clicked, referral information, cookies, pixels, and similar technologies. This information helps us learn about the Service, improve the user experience, measure performance, protect against fraud or abuse, and understand how visitors use the site.

If you opt in to receive marketing communications, or where otherwise permitted by law, we may use your email address to send updates about MarkTheirMoment.com, new features, promotions, product launches, stories, or other relevant information. You may unsubscribe from marketing emails at any time using the unsubscribe link in the email or by contacting us. We may still send transactional or service-related messages, such as order confirmations, approval notices, support responses, refund communications, policy updates, or security alerts.

The main reason we use your information is to provide a public digital Moment service: processing orders; supporting guest checkout and registered accounts; creating and displaying Moment pages and Moment Wall entries; generating share links and downloadable images; sending notifications; moderating content; responding to requests; maintaining records; protecting the Service; complying with legal obligations; and improving MarkTheirMoment.com.

3. Information We Collect

We may collect information in several ways and at several places on the Service, including when you browse the site, purchase a Moment, submit content, upload an image, create, register, or use an account, contact support, subscribe to updates, participate in forums or community areas we make available, interact with third-party social media websites or platforms such as Instagram, Facebook, TikTok, YouTube, LinkedIn, Pinterest, or X/Twitter, interact with social media profiles owned or operated by Mark Their Moment, or use sharing tools.

A. Information you provide directly

We may collect information you provide directly, including:

  • First name, last name, display name, recipient name, dedicator name, organization name, business name, cause name, pet name, or other display labels you choose to provide.
  • Email address, phone number, billing information, account information, username or login information, and password information.
  • Billing address and, if ever needed for physical merchandise, promotional items, mailings, prizes, chargeback verification, tax records, or other order-related reasons, shipping or mailing address.
  • Order information, including selected Moment tier, price, payment status, order date, order ID, refund status, chargeback status, and related transaction details.
  • Recipient name or display name, dedicator name or display name, dedication message, Moment caption, dedication date, Moment preferences, and Moment page customization choices.
  • Uploaded images, photos, image crops, image previews, downloadable share images, user profile images, and related image files.
  • Social media handles, social profile links, URLs, or other links you submit for a recipient, dedicator, organization, business, community, cause, pet, or other dedication subject.
  • Customer support messages, correction requests, removal requests, refund requests, abuse reports, moderation appeals, complaints, and other communications you send to us.
  • Marketing preferences, newsletter sign-ups, event or launch interest, survey responses, testimonials, user feedback, ideas, questions, comments, suggestions, and other voluntary submissions.
  • Any other information you choose to submit through forms, checkout pages, support pages, account pages, upload tools, text/share tools, forums, customer-community areas, public posts, comments, testimonials, or future community features.

B. Personal Account, Profile, and Registered-User Information

The Service allows users to create or register for an account in addition to checking out as a guest. When you create, register, access, use, or update an account, customer profile, or registered-user feature, we may collect information needed to create, authenticate, maintain, secure, and support that account. This may include your name, display name, email address, phone number, username or login identifier, password or password-related information, password reset information, account preferences, saved contact details, billing details, order history, submitted Moments, uploaded images, social profile links, saved Moment pages, communication settings, customer support history, and related account activity.

Registered accounts may help you view or manage past orders, checkout faster, access customer profile features, receive account notices, manage communication preferences, request support, submit or manage Moments where available, and use other account-related features offered through the Service.

You are responsible for maintaining the confidentiality of your account login credentials and for keeping your account, profile, order, billing, contact, and communication information accurate and up to date. If you believe your account has been accessed without authorization, contact us promptly.

If you provide an email address for an account, we may use it to send password reset messages, account notices, transactional messages, security alerts, order updates, support messages, privacy or policy notices, and other communications related to the Service. These account-related and transactional messages are separate from optional marketing communications. We encourage you to keep the email address you provide to us current and to promptly notify us of any changes to your email address so that you can receive account, order, security, privacy, and service-related notices.

C. Payment and checkout information

Payments are processed by third-party payment processors, commerce providers, banks, card networks, fraud prevention providers, and related service providers. We do not intend to store full credit card numbers on our own systems. We may receive limited payment-related information, such as payment method type, billing details, payment status, transaction identifiers, payment provider identifiers, fraud/risk signals, authorization status, refund information, chargeback information, and order records.

If you choose a direct payment gateway or checkout method, payment processors, WordPress.com, WooCommerce, Stripe, card networks, fraud-prevention providers, or other commerce partners may process payment data according to their own privacy policies and security practices.

Campus Offer Information

If you use the Campus Offer, we use the checkout email address you provide and its domain portion to determine eligibility, apply the offer, prevent or investigate misuse, troubleshoot checkout issues, and analyze aggregate campus participation. We may store whether the Campus Offer was applied and the normalized eligible .edu domain with the order. We do not publicly display your checkout email or associate you publicly with an institution through the Campus Offer unless you separately request or consent to that display through a feature that clearly provides that option.

D. Public Moment information

If you create a Moment, some information may be displayed publicly, including recipient or subject name or display name, dedicator name or display name, message, image, social profile link or handle, Moment tier (such as Classic, Featured, or Gold), visual-marker color, badge, label, Moment ID, dedication date, view count, Moment count, approval/public status, public URL, suggested caption, downloadable share image, and other public-page details.

E. User content, public submissions, and future community features

The Service may allow users to submit messages, photographs, profile images, public Moment pages, comments, captions, testimonials, questions, suggestions, support requests, or other content, including personal information. This includes personal information you provide in connection with your participation in any forums, customer-community areas, discussion boards, public guestbooks, public profile areas, comments, or other interactive features we make available. We and others may store, display, reproduce, publish, distribute, share, promote, or otherwise use public portions of that information online or offline in connection with operating, improving, displaying, promoting, and protecting the Service.

If we later add additional public comments, guestbooks, message boards, forums, reactions, community posts, public profiles, creator pages, nonprofit pages, organization pages, or other interactive features, information you submit to those areas may be public unless we clearly state otherwise.

F. Automated Collection of Information

When you browse or use the Service, we and our service providers may automatically collect information such as:

  • Internet Protocol (IP) address and approximate location derived from IP address.
  • Device identifiers, browser type, operating system, language settings, screen size, and device settings.

Automated collection may occur when you load a page, open an email, click a button, complete a checkout step, interact with a share tool, download an image, copy a caption, use a mobile device, or arrive at the Service from a social media platform, search engine, advertisement, email, or third-party link. Depending on the tools enabled on the Service, automated collection may be performed by us or by providers that support hosting, payments, analytics, advertising, fraud prevention, security, email delivery, content moderation, or social sharing.

G. Information from third parties and other users

We may receive information from service providers, payment processors, fraud prevention tools, hosting providers, analytics providers, advertising or retargeting providers if enabled, content moderation providers, email providers, security providers, social platforms, customer support tools, and other users who submit content involving you. For example, a dedicator may submit your name, image, message, or social profile link as part of a Moment.

4. Notice at Collection for California Residents

This section is intended to provide a California-style notice at collection. It describes the categories of personal information we may collect, the purposes for collection and use, and the categories of parties to whom information may be disclosed. The exact information collected depends on how you use the Service.

A. Categories of personal information we may collect

  • Identifiers: name, display name, email address, phone number, billing address, shipping or mailing address if applicable, IP address, account/order identifiers, social profile links, and social media handles.
  • California customer-records information: billing details, payment-related records, order records, customer support records, account records, and similar information.
  • Commercial information: Moment purchases, selected product/tier, order history, payment status, refund records, chargeback records, transaction history, and product preferences.
  • Internet or other electronic network activity: pages viewed, clicks, referring URLs, device/browser data, cookies, pixels, session data, log data, and interactions with the Service.
  • Approximate geolocation: approximate location inferred from IP address or device/browser signals. We do not intentionally request precise geolocation for ordinary use of the Service.
  • Audio, electronic, visual, or similar information: uploaded photos/images, cropped images, public Moment page images, downloadable share images, profile images, and other user-submitted media.
  • Inferences: preferences, product interests, interaction patterns, likely interests, engagement, or fraud/risk signals derived from use of the Service.
  • Sensitive personal information: we do not intentionally request sensitive personal information for ordinary Moments. However, users may voluntarily include sensitive information in names, messages, images, captions, links, support messages, or other submissions against our guidance.
  • Protected classification information: we do not intentionally request protected classification information, but users may voluntarily reveal or imply such information in public Moment content.

B. Purposes for collection and use

We may collect and use personal information to provide the Service, process purchases, verify payment information, create and publish Moments, manage public pages and Moment Wall entries, provide account, registration, login, customer profile, and order-history features, send order and approval messages, provide support, moderate content, prevent fraud and abuse, secure the Service, analyze site performance, improve user experience, provide more relevant content or advertising where enabled, comply with law, maintain business records, and enforce our Terms of Service.

C. Categories of sources

We may collect personal information from you, your device/browser, payment processors, commerce providers, hosting providers, analytics providers, advertising providers if enabled, security providers, content moderation providers, email providers, customer support tools, social platforms, and other users who submit content involving you.

D. Categories of recipients

We may disclose personal information to service providers, contractors, payment processors, commerce providers, hosting providers, analytics providers, advertising providers if enabled, security providers, content moderation providers, email providers, customer support tools, professional advisors, legal authorities where required, business successors, and the public when you submit information for public display.

E. Retention at collection

We retain information for the periods described in the “Data Retention” section below. In general, approved public Moments may remain available for the applicable active display period described in our Terms of Service and may continue to be displayed, archived, limited, retained, or removed afterward as described in our Terms of Service and this Privacy Policy. Order, tax, accounting, legal, moderation, support, security, and fraud-prevention records may be retained for longer where reasonably necessary or legally required.

5. Public Nature of Moments

Moments are designed to be public and shareable unless we clearly provide a private setting. Public Moment pages may be viewed by anyone with the link, displayed on a public Moment Wall, shared by visitors, copied, texted, downloaded, screenshotted, reposted, indexed by search engines, previewed by messaging apps, cached by browsers or search engines, and discussed outside the Service. Approved public Moments may remain publicly displayed for the applicable active display period described in our Terms of Service, subject to the Terms of Service and this Privacy Policy.

If you submit another person’s name, image, likeness, message, social profile, email address, or other personal information, you are responsible for making sure you have the appropriate permission or legal authority to do so.

We do not control who will have access to information you choose to make public, and we cannot ensure that people or third parties who access publicly available information will respect your privacy or keep it secure. This Privacy Policy does not apply to information that you disclose publicly, share with others, upload to publicly available portions of the Service, send to others outside the Service, or post on third-party platforms.

If a Moment is removed from active display on our Service, copies may still remain outside our control, including in screenshots, downloaded images, social media posts, search engine results, browser caches, text messages, emails, third-party archives, and copies retained by other users.

6. Discussion Boards, User Posts, Public Submissions, and Moment Pages

The Service is built around user-submitted public content. Depending on the features available, users may submit Moments, messages, photographs, pictures, images, videos if later supported, data, questions, suggestions, testimonials, comments, support messages, social links, captions, or other content through checkout forms, dedication forms, upload tools, support pages, contact forms, blogs, discussion boards, user posts, customer-community forums, public guestbooks, future message boards, future community features, or other interactive areas.

Public portions of those submissions may be displayed, reproduced, published, distributed, shared, promoted, archived, reformatted, resized, cropped, indexed, or otherwise made available online or offline in connection with operating, promoting, protecting, and improving the Service. For example, a public Moment page may show a recipient name, dedicator name, dedication message, uploaded image, social profile link, share caption, downloadable image, Moment ID, Moment count, or view count.

If we later add discussion boards, comments, public guestbooks, creator pages, nonprofit pages, recipient walls, community posts, or similar interactive features, information you submit to those areas may be public unless we clearly state otherwise. Account registration by itself does not make public Moment page content private; public Moment pages and other public submissions may still be public even when submitted by a registered account. Other people may view, copy, download, screenshot, repost, quote, index, or share public submissions. We do not control who chooses to view public content, what they do with public content after viewing it, or whether a third party keeps a copy.

You are responsible for the content you submit and for making sure you have the right or permission to submit and publicly display another person’s name, image, likeness, social profile, message, or other personal information. Do not submit private, sensitive, confidential, or unsafe information through public areas of the Service.

7. How We Use Information

We may use information to:

  • Operate, provide, maintain, test, and improve the Service.
  • Process purchases, payments, refunds, chargebacks, order confirmations, and related transaction records.
  • Create, review, approve, reject, publish, display, manage, moderate, remove, and update Moments.
  • Generate public Moment pages, public Moment Wall entries, shareable URLs, suggested captions, downloadable images, and related sharing tools.
  • Establish and maintain accounts, customer profiles, membership features, dashboards, registered-user features, account security, password resets, saved preferences, and order-history features.
  • Send password reset messages, account notices, transactional emails, order updates, approval notices, support replies, policy notices, and security communications.
  • Contact you about upcoming news, events, launches, product updates, or other information relevant to MarkTheirMoment.com if you opt in or where otherwise permitted by law.
  • Respond to customer support requests, correction requests, removal requests, refund requests, abuse reports, complaints, and legal requests.
  • Moderate content, detect prohibited content, prevent fraud, enforce our Terms of Service, and protect the rights, privacy, safety, and security of users, recipients, visitors, Hug Millionaire LLC, and the public.
  • Analyze site traffic, usage, checkout performance, feature adoption, errors, and product effectiveness.
  • Personalize or improve the user experience, including remembering preferences, access choices, logins, carts, and site settings where applicable.
  • Measure marketing effectiveness and, if enabled, deliver or evaluate electronic advertisements that may be more relevant to you.

Information you submit for a public Moment may be displayed publicly through the Service and may be shared by visitors, recipients, third-party platforms, messaging apps, search engines, or other services. We may also disclose information when you instruct us to do so, use a share feature, text or email a Moment, download an image, copy a caption, connect a third-party service, or otherwise provide consent.

B. Service providers and contractors

We may employ other companies and individuals to perform functions on our behalf. Examples include hosting, WordPress.com, WooCommerce, payment processing, fraud prevention, order fulfillment, email delivery, postal mail, customer service, obtaining user feedback, marketing assistance, analytics, search results and links, content moderation, security, cloud storage, database services, tax/accounting services, legal services, and maintaining, enhancing, or adding functionality to the Service.

These providers may have access to personal information needed to perform their functions, but they are expected to use it only for those functions and in accordance with applicable contractual, legal, or professional obligations.

C. Payment processors and commerce providers

When you make a purchase, payment and order information may be processed by third-party payment processors and commerce providers. These providers may process information under their own privacy policies and legal obligations. 9. If Hug Millionaire LLC Is Acquired, Merged, or Transferred

If Hug Millionaire LLC, MarkTheirMoment.com, our store, our assets, or a substantial part of our business is acquired by, merged with, financed by, reorganized with, or transferred to another company or owner, your information may be transferred to the new owner, successor, or related parties so that the Service may continue operating. This may include order records, public Moment pages, account records, support records, moderation records, and other information described in this Privacy Policy.

If a new owner or successor materially changes the way personal information is used or disclosed in a way that is materially different from this Privacy Policy, we or the successor will provide notice where required by law and where reasonably practicable. Notice may be provided by email, a notice on the Service, an updated privacy policy, or another legally appropriate method.

Because the Service supports account creation, if such a transfer occurs and you do not want your account information to be transferred or used under a materially changed privacy policy, you may request account cancellation or deletion by contacting us within thirty (30) days after the notice, unless a different period is stated in the notice or a longer period is required by law. Some information may still be retained where necessary for legal compliance, tax/accounting records, fraud prevention, dispute resolution, security, backups, public-interest purposes, or completion of transactions you requested. Public Moment pages, shared content, downloaded images, screenshots, cached pages, search engine results, social media posts, and copies outside our control may not be fully removable.

10. WordPress, WooCommerce, Hosting, and Payment Infrastructure

Our store and website may be hosted, powered, or supported by WordPress.com, WooCommerce, Automattic, hosting providers, domain providers, email providers, payment processors, fraud prevention providers, and related technology partners. These providers may provide the online e-commerce platform, data storage, databases, checkout tools, forms, plugins, security tools, analytics, and related applications that allow us to provide products and services to you.

Your data may be stored through these providers’ data storage, databases, applications, servers, cloud systems, and security infrastructure. These providers may have their own terms, privacy policies, security practices, retention practices, and legal obligations.

Payment processing and PCI-DSS

If you choose a direct payment gateway or other payment method to complete your purchase, payment processors or commerce partners may process your credit card or payment information. We do not intend to store full credit card numbers on our own systems. Payment processors and payment gateways are generally responsible for handling payment card information in accordance with applicable payment-card security standards, including PCI-DSS where applicable.

Transaction information may be stored only as long as needed by us and our service providers to complete the purchase, process refunds or chargebacks, prevent fraud, maintain business/tax/accounting records, comply with legal obligations, and resolve disputes.

11. Third-Party Services, Links, and Different Jurisdictions

The Service may contain links to social media profiles, third-party websites, payment pages, messaging apps, app stores, analytics tools, advertising tools, or other services that we do not own or control. Examples may include Instagram, TikTok, YouTube, Facebook, LinkedIn, X/Twitter, Pinterest, WordPress.com, WooCommerce, payment processors, email providers, analytics providers, advertising providers if enabled, and other services.

Third-party providers used by us generally collect, use, and disclose information only to the extent necessary to allow them to perform the services they provide to us, but certain providers, such as payment gateways, payment processors, analytics providers, advertising providers, and social media platforms, have their own privacy policies and legal obligations.

Some third-party providers may be located in, or have facilities located in, jurisdictions different from yours or ours. If you proceed with a transaction or interaction involving a third-party service provider, your information may become subject to the laws of the jurisdiction in which that provider or its facilities are located.

Once you leave MarkTheirMoment.com or are redirected to a third-party website, application, payment page, social media platform, or messaging service, you are no longer governed by this Privacy Policy or our Terms of Service. We are not responsible for the privacy practices, content, security, availability, or accuracy of third-party services. We encourage you to read the privacy policies of other sites and services.

12. Social Media Features, APIs, Plug-ins, Embeds, and Sharing Tools

The Service may interface with social media networks or platforms such as Instagram, TikTok, Facebook, Pinterest, X/Twitter, YouTube, LinkedIn, and others. You may be able to submit social profile links, open a social profile, use a share button, send a Moment through a messaging app, embed or preview content, or interact with social media plug-ins, APIs, pixels, or buttons.

If we offer a social login, social connection, API integration, or similar feature in the future, and you choose to connect your social media account, we may collect, store, and use information that you authorize the social media platform to provide to us, subject to this Privacy Policy, the platform’s privacy policy, the platform’s API rules, and your privacy settings. Depending on the platform and your settings, this may include information such as your name, profile picture, email address, username, public profile information, or other information you authorize.

If social media plug-ins, embeds, pixels, buttons, or sharing tools are enabled, those platforms may set cookies or similar technologies on your browser, recognize that you visited the Service, receive information about pages you viewed or actions you took, and connect that visit to your account if you are logged into that platform. We may maintain social media profiles, pages, accounts, or channels for Mark Their Moment on platforms such as Instagram, Facebook, TikTok, YouTube, LinkedIn, Pinterest, X/Twitter, or other services. If you follow, like, comment on, tag, mention, message, share, save, repost, react to, or otherwise interact with social media profiles owned or operated by Mark Their Moment or posts, we may receive or view information that the platform makes available to us. This may include your social media username or handle, public profile information, profile image, comments, messages, reactions, tags, mentions, shared content, engagement metrics, and other information you make available through that platform and your privacy settings.

We may use information from these interactions to respond to you, provide support, moderate comments or messages, understand engagement, measure marketing effectiveness, improve the Service, identify potential abuse or safety issues, and promote MarkTheirMoment.com, Moments, public submissions, user stories, campaigns, launches, or community moments. For example, if you submit a Moment, provide a social handle, tag Mark Their Moment, comment on a Mark Their Moment post, or otherwise interact with our social media presence, we may use that interaction to understand how people are sharing Moments, respond to your post, repost or share public content where appropriate, tag or mention public accounts where you have provided the information or engaged publicly, or feature public Moment-related content in connection with the Service.

Your interactions with our social media profiles are also governed by the privacy policies, terms, settings, and data practices of the relevant social media platform. We do not control how those platforms collect, use, combine, disclose, or retain information about your interactions with social media profiles owned or operated by Mark Their Moment.

Instagram / Meta example

For example, if a Moment page includes an Instagram profile link, Instagram embed, Instagram share option, Meta pixel, Meta plug-in, or similar Instagram/Meta feature, Meta may receive information such as the page you visited, the button or feature you clicked, your IP address, browser and device information, cookie identifiers, and the time of your visit. If you are logged into Instagram or another Meta service, Meta may associate your interaction with your Meta account depending on Meta’s settings and privacy practices. Hug Millionaire LLC does not control how Instagram, Meta, or other social media platforms collect, use, combine, or retain information once you interact with their features or leave the Service.

We do not control what social media platforms or plug-ins collect, store, or use. Before connecting a social account or using social features, please review the privacy policy and settings of the applicable social media service.

We do not ask for, and you should not provide, your third-party social media password through ordinary MarkTheirMoment.com dedication forms.

18. Texting, Sharing, Downloading, and Copying Content

The Service may include share tools such as Copy Link, Text This Moment, Share, Download Image, and Copy Caption. When you use these tools, your device, browser, operating system, messaging app, social platform, or third-party sharing service may process the information you choose to share.

If you text, email, download, copy, screenshot, or post a Moment outside the Service, we do not control how recipients, platforms, search engines, messaging apps, or other third parties use or store that information.

19. Image Uploads and Metadata

If you upload an image, we may store, crop, resize, compress, convert, display, publish, moderate, and create share versions of that image in connection with the Service. Images may contain embedded metadata, such as device or location data, depending on how the photo was created and uploaded. Please remove any metadata you do not want associated with the image before uploading.

We do not intend to use uploaded images for biometric identification or authentication. However, uploaded images may be publicly displayed if included in a public Moment.

20. Content Moderation and Safety Review

We may review submitted content before or after publication. This review may be performed manually, automatically, or with the help of third-party content moderation, security, fraud-prevention, abuse-prevention, or safety service providers, including OpenAI. Submitted names, messages, images, links, captions, metadata, social profile links, URLs, account details, order details, and related information may be transmitted to and processed by OpenAI and other applicable providers for moderation, fraud prevention, abuse prevention, security, safety review, legal compliance, and enforcement of our Terms of Service.

We may reject, hide, edit for formatting, remove, disable, change, or refuse to publish content, links, social profile links, URLs, or Moments that we believe are inappropriate, unsafe, unlawful, misleading, abusive, exploitative, offensive, infringing, spammy, low quality, harmful to privacy or safety, inconsistent with the spirit of the Service, or otherwise unsuitable for MarkTheirMoment.com.

We may also review, remove, hide, disable, or change links, social profile links, URLs, or Moments after publication if a linked social media profile, external URL, embedded content, or third-party page later becomes broken, misleading, unsafe, malicious, adult-oriented, unlawful, infringing, inappropriate, unavailable, or otherwise unsuitable for the Service.

21. Marketing Communications

If you sign up for updates, make a purchase, or otherwise opt in where required, we may send you marketing emails about MarkTheirMoment.com, product updates, promotions, stories, launches, events, or related news. You can unsubscribe from marketing emails using the unsubscribe link in the email or by contacting us.

Even if you opt out of marketing emails, we may still send transactional or service-related messages, such as order confirmations, approval notices, support replies, policy notices, refund communications, or security alerts.

22. Age of Consent, Children, and Minors

By using the Service to make a purchase or submit a Moment, you represent that you are at least the age of majority in your state or jurisdiction of residence.

The Service is not directed to children under 13. In accordance with the Children’s Online Privacy Protection Act, commonly known as COPPA, we do not knowingly collect personal information directly from children under 13 without verifiable parental consent. Children under 13 may not make a purchase, create an account, submit a Moment, upload content, link a social profile, or otherwise submit personal information through the Service.

A Moment involving a minor may be submitted only by the minor’s parent or legal guardian, or by someone with appropriate permission and legal authority to submit and publicly display the information provided. Parent or legal guardian approval does not mean that a child under 13 may directly use the Service to make a purchase, create an account, submit a Moment, upload content, link a social profile, or otherwise submit personal information. A parent, legal guardian, or properly authorized adult should submit the Moment on behalf of the minor.

Do not submit private, sensitive, or unsafe information about minors, including home addresses, school locations, exact locations, private phone numbers, government IDs, medical information, or other sensitive information.

We do not knowingly sell or share personal information of consumers under 16. We may remove content involving minors if we believe it creates privacy, safety, legal, or reputational concerns.

23. Sensitive Personal Information

Do not submit sensitive personal information through the Service unless we specifically request it and it is necessary. Sensitive information may include government identification numbers, Social Security numbers, financial account numbers, passwords, precise home addresses, medical information, health information, genetic or biometric information, private school locations of minors, or other highly sensitive details.

We do not intentionally request sensitive personal information for ordinary Moments. If you include sensitive information in a public Moment, customer support message, image, caption, social link, or other submission, we may remove it, but we cannot control copies that have already been shared, downloaded, indexed, cached, or stored by others.

24. Security

To protect personal information, we use reasonable administrative, technical, and organizational safeguards designed to reduce the risk of unauthorized access, loss, misuse, alteration, disclosure, or destruction. These safeguards may include access controls, encryption where appropriate, secure payment processing through third-party providers, monitoring, backups, security tools, fraud-prevention tools, and security practices appropriate for the nature of the information.

If payment information is processed through a direct payment gateway or payment processor, payment-card information may be encrypted or protected by that provider’s systems. Payment processors and payment gateways are generally responsible for complying with PCI-DSS and other payment-card security requirements applicable to their services.

Although we take reasonable precautions and follow appropriate practices, no method of transmission over the Internet and no method of electronic storage is 100% secure. We cannot guarantee absolute security. You are responsible for using the Service carefully and avoiding submission of information you would not want made public.

25. Data Retention

Approved public Moments may remain available for the applicable active display period described in our Terms of Service and may continue to be displayed, archived, limited, retained, or removed afterward as described in our Terms of Service and this Privacy Policy. Transaction records, support records, moderation records, logs, and legal records may be retained for longer periods where reasonably necessary or legally required.

We retain communications and records of requests as long as necessary for our business and legal obligations. We also retain aggregate, non-identifying usage statistics and security/abuse-prevention logs on an ongoing basis.

When information is no longer needed, we may delete, de-identify, aggregate, archive, or securely retain it according to our business and legal needs.

If your request involves a public Moment submitted by someone else, a recipient, a dedicator, an image, a social profile, or another person’s rights, we may request additional information before taking action.

We may deny or limit requests where permitted by law, including where information is needed for security, fraud prevention, legal compliance, transaction records, dispute resolution, public interest, freedom of expression, protection of others’ rights, or other lawful reasons.

27. California Privacy Notice and CPRA/CCPA Rights

This section applies to California residents where California privacy laws apply, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA).

Depending on applicable law, California residents may have the right to:

    We do not use sensitive personal information for purposes other than those permitted by applicable law unless we provide notice and any required choice. We do not knowingly sell or share personal information of consumers under 16.

    A. California request verification

    Before responding to certain requests, we may verify your identity by asking for information that matches information we already maintain, such as your email address, order number, transaction details, or other information reasonably related to your request. For requests involving public Moment pages, recipients, dedicators, uploaded images, or third-party submissions, we may require additional verification or authority to protect the privacy and rights of others.

    B. Authorized agents

    Where permitted by California law, you may use an authorized agent to submit a privacy request on your behalf. We may require proof that the agent is authorized to act for you and may also require you to verify your identity directly with us unless an exception applies.

    C. Response timing

    We will respond to verified privacy requests within the time required by applicable law. For California requests, this is generally 45 calendar days, with a possible extension where permitted by law. If we need more time, we will let you know when required.

    D. California Shine the Light

    California Civil Code Section 1798.83, sometimes called “Shine the Light,” permits California residents to request certain information about our disclosure of personal information to third parties for their direct marketing purposes during the preceding calendar year, where applicable.
